Domestic Violence Visa: VAWA – Violence Against Women Act

          Abuse is a problem in our society that affects all ethnic communities in disregard of their race, age, gender, class or status. This is an action that is often times considered a crime. There are many different types of actions that fall into the abuse category, such as physical assault, sexual assault, battery, and threats. Our office has a lot of compassion for individuals who are placed in this situation and have suffered a great amount hardship in their lives. Sometimes trauma takes control of a person and they experience fearfulness to speak up. Many individuals are simply afraid just for the fact that they are undocumented and are told they don’t have rights. We believe that no one deserves to be mistreated and hurt in any way.

          Violence Against Women Act, commonly known as VAWA, is a type of visa recognized by Congress to protect immigrants and their children against a U.S. Citizen or Legal Permanent Resident abuser. There are special requirements that have to be met to complete the petition, but in the long run it is a process that eventually will get the victim’s status legalized. Inadmissibility issues, as we have come to find out, play a great role in our immigration world. As we have discussed previously, there are waivers for different types of inadmissible actions that can be filed for. VAWA petitioners are eligible for a discretionary waiver that waives numerous areas of inadmissibility.

          Our country deserves families to be happy and safe. This visa focuses on the interest of the public to provide an equal and safe environment for everyone.

          El abuso es un problema en nuestra sociedad que afecta a todas las comunidades étnicas sin tener en cuenta su raza, edad, género, clase o condición. Esta es una acción que es frecuentemente considerado como un crimen. Hay muchos diferentes tipos de acciones que caen en la categoría de abuso, como el asalto físico, asalto sexual, violencia y amenazas.            La Acta de Violencia contra las Mujeres, conocida como VAWA es un tipo de visa reconocido por el Congreso para proteger a los inmigrantes y sus hijos en contra de un abusador Ciudadano de Estados Unidos o Residente Legal Permanente. Hay requisitos especiales que se deben cumplir para completar la petición, pero a lo largo  es un proceso en el cual finalmente obtiene el estado de la víctima legalizado. Problemas de inadmisibilidad, como hemos llegado a saber, desempeñan un gran papel en el mundo de la inmigración. Como hemos comentado anteriormente, existen exenciones para los diferentes tipos de acciones inadmisibles que se pueden presentar. Peticionarios VAWA son elegibles para un perdon discrecional que perdona numerosos ámbitos de la inadmisibilidad.

          Nuestro país se merece que las familias sean feliz y que esten seguras. Esta visa se ​​centra en el interés del público para proporcionar un ambiente de igualdad y segurida para todos.

Waivers Are Our Focus!!

Well, not our only focus, but definitely one of them! We do multiple types of waivers for numerous areas of inadmissibility. For instance, common areas of inadmissibility include, but are in no way limited to: unlawful presence, misrepresentation, previous criminal convictions, medical conditions and visa overstay.  There are roughly 50 different reasons a person can be found inadmissible to the US. Once a person is found to be inadmissible, a waiver will most likely be required before someone can get their residency.  Common waivers we file are the I-601 Waiver of Inadmissibility and various types of I-212 waivers.

Not all areas of inadmissibility are eligible for a waiver. Be sure to check with a licensed Immigration Attorney regarding this issue! Many problems in cases we encounter could have been prevented with proper counsel, had the individuals sought advice prior to filing their petitions. 

Our attorney, Michael, is extremely experienced in preparing waivers. Through hard work and the grace of God, as of today, Feltman Law Firm has 100% success in waiver approvals. We do currently have several pending and our prior success can in no way guarantee future success.
